Rental Policies

These rental policies explain the general terms for reservations, deposits, equipment care, weather, cancellations, delivery, pickup and customer responsibilities when renting from La Werita Party Rentals.

Bookings & Deposits

All reservations are subject to availability. A reservation is confirmed only after the required deposit or reservation payment shown during checkout or on the invoice has been successfully received.

Unless otherwise stated in writing on the invoice, required deposits are non-refundable because the selected equipment and event date are being held for the renter.

Any remaining balance must be paid according to the due date and payment instructions shown on the invoice or rental checkout. La Werita Party Rentals may withhold delivery, setup or release of equipment until required payment has been completed.

Damage Policy & Equipment Care

The renter is responsible for rented equipment from delivery or customer pickup until the equipment is returned to, or collected by, La Werita Party Rentals.

Damage Waiver

If an optional damage waiver is offered and purchased, it is a non-refundable fee intended for qualifying minor accidental damage. A damage waiver does not cover negligence, abuse, theft, loss, intentional damage, prohibited substances or damage outside the waiver terms.

Repairable Damage

When rented equipment can be professionally repaired, the renter may be charged the reasonable repair cost, including applicable parts, labor, transportation, logistics or shipping.

Loss, Theft or Non-Repairable Damage

If equipment is lost, stolen or damaged beyond reasonable repair, the renter is responsible for the current replacement cost of comparable new equipment. Permanent stains, cuts, burns, chemical damage or structural damage may be treated as non-repairable when restoration is not practical.

Prohibited Products & Substances

Silly String, paint, face paint, markers, adhesives, chemicals and other substances that can permanently stain or damage vinyl, fabric, upholstery or rental surfaces must be kept away from rental equipment. Damage caused by prohibited substances is not considered ordinary wear.

Safety & Weather Policy

Adult Supervision for Inflatables

Bounce houses and other inflatable or interactive rental equipment must be supervised by a responsible adult age 18 or older whenever the equipment is in use. Riders must follow posted, delivered or manufacturer safety instructions and capacity limits.

Unsafe Weather

La Werita Party Rentals may delay, cancel, suspend use of, deflate or remove rental equipment when weather or site conditions are considered unsafe. This includes lightning, heavy rain, severe storms or wind conditions that exceed the safe operating limits for the specific equipment. Manufacturer instructions and equipment-specific safety limits control when they are more restrictive.

Customer Responsibility After Delivery

The renter must stop use immediately if conditions become unsafe after delivery or setup and contact La Werita Party Rentals when instructions are needed. Safety equipment, anchors, stakes, straps and ballast must not be removed or altered by the renter.

Specialized Equipment & Setup Rules

Tents

The renter is responsible for providing a safe, accessible setup area. Before any tent is staked, the property owner or renter must identify and disclose underground utilities, irrigation, electrical lines, gas lines or other hazards. Cooking, open flames and heat sources under or near tents are prohibited unless specifically approved for the equipment and setup.

Throne Chairs & Decorative Furniture

Throne chairs and decorative furniture must be used appropriately and protected from stains, moisture, excessive weight, climbing and misuse. Do not relocate installed specialty pieces without approval when moving them could damage the item or the event setup.

Chandeliers & Lighting

Chandeliers and installed lighting must not be disconnected, moved, modified or used to support decorations or other objects. Only authorized personnel should alter installed lighting or draping components.

Custom Draping & Decorations

Installed draping, fabric, decorative structures and related components must remain in the installed configuration unless La Werita Party Rentals authorizes a change. The renter is responsible for preventing guests, vendors and other parties from pulling, climbing on, cutting, staining or altering the setup.

Assumption of Risk & Responsibility

Rental equipment can involve risks if it is misused, moved, overloaded, operated during unsafe weather, used without appropriate supervision or used contrary to safety instructions. The renter accepts responsibility for supervising the rental site and for ensuring that guests and users follow the applicable instructions.

To the fullest extent permitted by applicable law, the renter is responsible for claims, losses or damage caused by the renter’s misuse, unauthorized modification, negligence, failure to supervise or failure to follow safety instructions. Nothing in these policies is intended to waive rights or obligations that cannot legally be waived under applicable law.

Governing Law

These rental policies and related rental agreements are governed by applicable laws of the State of Texas. Any dispute or legal proceeding will be handled in the appropriate court or forum as required by applicable law and the terms of the renter’s invoice or rental agreement.

Cancellation & Refund Policy

Deposits

Deposits are non-refundable unless La Werita Party Rentals agrees otherwise in writing. The deposit reserves the selected equipment and event date and may cause that inventory to be unavailable to other customers.

Standard Cancellations

Cancellations made more than 7 days before the scheduled event date may receive a credit equal to the deposit amount for use toward a future rental within 6 months, subject to availability and any written limitations provided with the credit.

Cancellations made within 48 hours of the event date result in forfeiture of the deposit and may be subject to a cancellation fee equal to 20% of the total rental balance.

Weather-Related Cancellations

La Werita Party Rentals may cancel or postpone delivery, installation or use when weather conditions make the rental unsafe. When La Werita Party Rentals cancels an installation for unsafe weather before setup, the deposit may be issued as a credit toward a future available date.

Once rental equipment has been delivered, set up or installed, later weather changes do not automatically qualify the rental for a refund or credit.

No-Show or Inaccessible Site

If the renter or authorized contact is not present when required, or if the delivery/setup area is not ready, safe or accessible at the agreed time, the driver may wait up to 15 minutes before continuing the route. A failed delivery caused by customer absence or an inaccessible/unprepared setup area may be treated as a cancellation, and the rental balance may remain due.

Delivery, Setup, Pickup & Site Access

The renter must provide accurate event and delivery information and ensure that the property can be safely accessed by the delivery team. Gates, stairs, elevators, parking restrictions, long carries, narrow access points and other site conditions should be disclosed before delivery.

The setup area must be clear of vehicles, debris, pets, obstacles and other conditions that prevent safe delivery or installation. Equipment should remain in the agreed location unless La Werita Party Rentals authorizes relocation.

At pickup, all rented items must be accessible, reasonably organized and free of customer property, decorations, trash or food unless the rented service specifically includes removal of those materials.

Acceptance of Rental Policies

By completing a reservation, paying a deposit, accepting delivery or taking possession of rented equipment, the renter acknowledges the applicable rental terms, safety instructions, invoice details and policies associated with the order.

If an invoice, checkout confirmation or signed rental agreement contains terms that are more specific to the order, those order-specific terms should be reviewed together with this policy.
